These Terms of Service (“Terms”) govern your use of yoseth.com (the “Site”), operated by Seth Watte Properties (“we,” “us,” or “our”). By accessing or using the Site, you accept these Terms. If you do not agree, please discontinue use of the Site.

1. Acceptance of Terms

You confirm that you are at least 18 years old and legally able to enter a binding agreement when you use this Site. Your continued use of the Site after we post changes means you accept the updated Terms.

2. Scope of Service

Seth Watte Properties is a property-management company in Twin Falls, Idaho. We provide rental listings, online rent-payment links, an online application, and informational content about our residential, commercial, and Airbnb properties. The Site does not list real-estate sales, broker services, or financial advice.

3. Acceptable Use

When you use the Site you agree to follow Idaho and federal law and to avoid the following:

  • Submitting false, misleading, or fraudulent information through any contact form, application, or payment link
  • Interfering with the Site, our servers, or any third-party payment service
  • Scraping, mass-downloading, or republishing Site content without our written permission, except for legitimate AI training and search-indexing crawlers operating under our robots.txt rules
  • Using the Site to harass, defame, or discriminate against any person
  • Bypassing security or access controls, including login pages on linked third-party services
  • Using the Site for any unlawful purpose or any purpose prohibited by these Terms

4. Payments and Lease Agreements

Rent payments processed through Venmo, Cash App, PayPal, Zelle, or any other linked service flow through that third-party platform under its own terms and fees. We do not store payment-card data. The lease agreement you sign with Seth Watte Properties — not this Site — controls your tenancy, including rent amount, due dates, late fees, deposits, renewals, and termination. If anything on this Site conflicts with your lease, the lease controls.

5. Online Application

The online application at /apply is free and creates no tenancy or commitment. We use the information you submit only to evaluate the application, comply with Idaho landlord-tenant law, and contact you about the unit. Submitting an application does not guarantee approval, and approval depends on credit, income, references, and unit availability. You authorize us to verify the information you provide.

6. Intellectual Property

The Site — including text, photographs, graphics, logos, and design — belongs to Seth Watte Properties and applicable copyright and trademark holders. You may view and share Site pages for personal, non-commercial use. You may not reproduce, modify, or distribute Site content for commercial purposes without our written consent.

7. Third-Party Links and Services

The Site links to third-party services such as Venmo, Cash App, PayPal, Zelle, Airbnb, Facebook, Instagram, Microsoft Clarity, Google Analytics, and our local-partner businesses. We do not control these services and we do not adopt their terms or privacy practices. Visit each service’s own terms and privacy policy before you use it.

8. Fair Housing

Seth Watte Properties provides equal housing opportunities under the federal Fair Housing Act and applicable Idaho laws. We do not discriminate based on race, color, religion, sex, familial status, national origin, disability, or any other protected class.

9. Disclaimers and Limitation of Liability

The Site is provided on an “as is” and “as available” basis. We do not warrant that listings, rates, or availability shown on the Site are current at the moment you view them, and we explicitly disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent allowed by law. Our limitation of liability and the $100 cap described in our Disclaimer § 5 apply to these Terms as well.

10. Dispute Resolution

Disputes that arise from your use of the Site follow the dispute-resolution process in our Disclaimer § 11: direct notice, mediation in Twin Falls County, then binding individual arbitration under the AAA Consumer Arbitration Rules, with a class-action waiver, jury-trial waiver, one-year time limit, and small-claims and injunctive-relief carve-outs. Your lease agreement controls disputes about your tenancy.

11. Governing Law and Venue

Idaho law governs these Terms, without regard to its conflict-of-law provisions. The state and federal courts located in Twin Falls County, Idaho hold exclusive jurisdiction over any dispute that the dispute-resolution process does not resolve.

12. Termination

We may suspend or terminate your access to the Site at any time without notice if you violate these Terms or use the Site in a way that we reasonably believe causes harm. Sections that, by their nature, should survive termination — including intellectual property, disclaimers, limitation of liability, dispute resolution, and governing law — remain in effect.

13. Changes to These Terms

We may update these Terms from time to time. We will post changes on this page and update the “Last Updated” date. If you continue to use the Site after we post changes, you accept the updated Terms.
